ROGERS PLANNING COMMISSION
JULY 19, 2011
CALL TO ORDERThe meeting of the Rogers Planning Commission was held on July 19, 2011 at 7:00 p.m. was called to order with Commissioners, Breun, Denker, Noto, Kornovich and Busch present.
Also present were City Planning Consultant Rose Lorsung, Deputy Clerk Splett and Councilmember Ihli.
Member(s) excused: Ende, Knapp and Terhaar.
OPEN FORUMNo one wished to speak.
SET AGENDAChairman Noto inquired if there was anyone who wished to place an item on the Agenda.
The agenda was set as submitted.
CONSENT AGENDA*A. Approval of the June 21, 2011 Planning Commission MinutesCommissioner Breun moved, Commissioner Denker seconded a motion to approve the Consent Agenda as submitted.
On the vote, members voted AYE. Motion carried.
PUBLIC HEARINGSA. Public Hearing to Consider a Request by Saint Jude Medical for a Conditional Use Permit for Outside Storage, Located at 19725 S. Diamond Lake RoadPlanning Consultant Lorsung provided the background information commenting on the following:• Owner of the property is Cobalt Industries Real Estate Investment Trust• Property is being leased by St. Jude's and then sub-leased to AorTech Biomaterials• This is an approved use in the LI district, the conditional use permit is for the outside storage of a liquid nitrogen tank outside• Request has been reviewed by the Fire Chief, Building Inspector, and Public Works Supt.• There will be a cement slab poured for the tank to sit on• Proposing a 8 ft. chain link fence for security
Chairman Noto opened the meeting for public comment.
The following comments were registered:Greg Chiponis, representative for AorTech: The recommendation by the supplier of the tank is to have a chain link fence around it, for safety purposes, its economical and you are able to see through it. The fence could be 6 or 8 feet in height – either would be okay.Commissioner Noto inquired what the height of the tank is.Commissioner Kornovich commented that the tank is approximately 9 feet high and with a 6 foot fence there would still be 3 feet above the fence.Greg Chiponis had a picture of the tank with fencing that he showed to the Planning Commission.Commissioner Denker stated that this is a safety issue year round.Chris Hickok, representative for Cobalt Industries commented that the fenced in area is located in the truck court between the two buildings for aesthetics.Commissioner Noto commented that there are concrete posts also protecting the tank.Commissioner Busch stated that is a containment system.
Commissioner Noto moved, Commissioner Denker seconded a motion to close the public hearing.On the vote, all members voted AYE. Motion carried.
The Planning Commission discussed the following:• With a chain link fence you can see through it from a distance and it also provides a safety aspect• No problem with the chain link fence – but we required others to have the slats for other outside storage areas.• 8 foot open chain link fence vs. 8 foot chain link fence with slats or 8 foot wood fence
Commissioner Denker moved, Commissioner Breun seconded a motion to recommend approval a request by Saint Jude Medical for a Conditional Use Permit for outside storage, located at 19725 S. Diamond Lake Road subject to the following conditions:1. The approval is for 19725 South Diamond Lake Road.2. The fire marshal must sign off on all plans prior to construction.3. The applicant must erect an eight-foot chain link fence and apply for a building permit for the fence.4. The City must review and approve sign permits for the building.5. The City must review and approve all construction permits.6. The Conditional Use Permit must be recorded.
On the vote, all members voted AYE. Motion carried.
B. (cont.) Public Hearing to Consider a Minor Amendment to the Zoning Ordinance, Section 125-57 and Section 125-58, Relating to Variances.Planning Consultant Lorsung provided the background information commenting on the following:• All the due diligence information was provided to you last month• The proposed variance amendment ordinance has been reviewed by the Joint Planning Board and Hassan.• The proposed changes have been agreed on• Reviewed the 4 major changes
The following comments were registered:Dick Martin, 25065 Hassan Pkwy.: We reviewed this at the Joint Planning Board meeting and found it to be adequate and correct.
Commissioner Noto moved, Commissioner Breun seconded a motion to close the public hearing.On the vote, all members voted AYE. Motion carried.
Commissioner Noto moved, Commissioner Denker seconded a motion to recommend approval of the amendments in the staff report for consideration by the City Council at the July 26th Council meeting.On the vote, all members voted AYE. Motion carried.
OTHER BUSINESSA. Medline Plan Distribution (information only)Planning Consultant Lorsung provided the background information commenting on the following:• Medline is the first user in the multiple phased PUD at this location• There will not be an official review by the Planning Commission• This is a working copy of what will be before the City Council on July 26th• They will receive an early grading permit and hope to begin footings the 1st week of August with an anticipated opening of spring 2012• This will be the first LEED certified building in the City of Rogers
There was a brief discussion by the Planning Commission in regards to the curb cut being approved on Brockton Lane.
