APRIL 20, 2010

The meeting of the Rogers Planning Commission was held on April 20, 2010 at 7:00 p.m. was called to order with Commissioners Kornovich, Ihli, Noto, Knapp, Breun, Stanley, and Denker present.  

Also present were City Planning Consultants Rose Lorsung, Deputy Clerk Splett, and Councilmember Bell.

Member(s) excused:  Terhaar and Olsen.

No one wished to speak.

Chairman Noto inquired if there was anyone who wished to place an item on the Agenda.

The agenda was set as submitted.

A.   Approval of the March 16, 2010 Planning Commission Minutes

Commissioner Ihli moved, Commissioner Stanley seconded a motion to approve the Consent Agenda with corrections to minutes.

On the vote, all members voted AYE, with member Noto abstaining.  Motion carried.

A.  Public Hearing to Consider a Request by NTC Homes, Inc. for a variance for a reduced rear yard setback for the construction of a deck at 23468 128th Ave. N.
Planning Consultant Lorsung provided the background information commenting on the following:
  • Technical variance
  • Illegal non-conforming use
  • This is a unique situation – applicant does have a hardship
  • Rear yard setback is 30 feet, applicant is requesting 17.5 foot variance

Chairman Noto opened the meeting for public comment. 

The following comments were registered:
Neil Klingelhutz, NTC Homes, Inc.:  I am asking for the variance to replace the deck that was once on the home.  The deck was removed last fall to hook the property up to water and sewer service.
Commissioner Noto inquired if the new road will now create a problem for future homes to be built.
Planning Consultant Lorsung stated that would not be a problem.  The new homes won’t line up with this existing home.  All of the new homes will meet the setbacks.
Commissioner Breun inquired if the homes would be accessed from 129th Ave.
Planning Consultant Lorsung stated that the new homes will all be accessed from 128th Ave.

Commissioner Kornovich moved, Commissioner Knapp seconded a motion to close the public hearing.

On the vote, all members voted AYE.  Motion carried.

The Planning Commission discussed the following:
  • The size of the deck.  Would the applicant be okay with an 8 ft. deck vs. 12 ft. deck?
  • Applicant stated he would be able to live with a 10 foot deck.  An 8 foot deck does not provide enough room with a table, chairs, etc.
  •  Could the driveway be changed to come off of Breckenridge?
  • Future applications for new plats should provide information to the Planning Commission of existing structures on the property so that we do not run into a situation like this again
  • Buyers/builders/homeowners should be made aware of where they can put decks, fences, sheds, etc.

Commissioner Kornovich moved, Commissioner Noto seconded a motion  to approve the variance from the rear yard setback to replace the deck that was removed in order to hook up the property to public services, subject to the condition that the applicant apply for a building permit.

On the vote, all members voted AYE.  Motion carried.


A.  Verbal Update Regarding the Interim Use Permit/Home Occupation and the Abandoned Homes Issue

Planning Consultant Lorsung provided a verbal update the Planning Commission on the following:
  • The public hearing will be held at the May meeting for the Interim Use Permit/Home Occupation ordinance to provide more time to construct the text of the ordinance
  • If the Commissioners have any additional information or comments please provide them for review
  • The Abandoned Homes  ordinance has been put aside for now due to lack of resources and a limited budget
  • There will be a large zoning ordinance amendment with the second phase of the annexation that will happen in August of this year

Commissioner Knapp moved, Commissioner Ihli seconded a motion to adjourn the meeting at 7:32 p.m.

On the vote, all members voted AYE.  Motion carried.
